Physicians Credentialing provides comprehensive medical credentialing services, including but not limited to:
- Primary source verification of credentials
- Hospital and facility credentialing
- Insurance payer enrollment and paneling
- Re-credentialing services
- Specialty-specific credentialing
- State licensing assistance
- Contract negotiation support
3. User Responsibilities
Information Accuracy
You agree to provide accurate, complete, and current information for all credentialing applications. You are responsible for promptly updating any changes to your credentials, contact information, or professional status.
Document Submission
- Submit all required documents in a timely manner
- Ensure all documents are legible and complete
- Provide original or certified copies when required
- Respond promptly to requests for additional information
4. Payment Terms
Payment terms are established in individual service agreements. General payment policies include:
- Fees are due according to the agreed payment schedule
- Payment plans may be available for comprehensive services
- Late payment fees may apply as specified in service agreements
- Refunds are handled according to our refund policy
- All fees are subject to applicable taxes
5. Service Limitations
While we strive to expedite the credentialing process, we cannot guarantee:
- Specific timeframes for completion due to third-party dependencies
- Approval of credentialing applications
- Acceptance by specific healthcare organizations or payers
- Immunity from changes in credentialing requirements
Credentialing decisions are made solely by healthcare organizations and insurance companies, not by Physicians Credentialing.
6. Confidentiality and Privacy
We maintain strict confidentiality of all client information in accordance with:
- HIPAA regulations and healthcare privacy laws
- Professional confidentiality standards
- Our Privacy Policy (incorporated by reference)
- Applicable state and federal privacy regulations
7. Intellectual Property
All content, software, and materials provided by Physicians Credentialing are protected by intellectual property laws. You may not:
- Reproduce, distribute, or modify our proprietary materials
- Use our trademarks or service marks without permission
- Reverse engineer any software or systems
- Share login credentials or access information
8. Limitation of Liability
To the maximum extent permitted by law, Physicians Credentialing shall not be liable for:
- Indirect, incidental, or consequential damages
- Lost profits or business opportunities
- Delays caused by third-party organizations
- Changes in credentialing requirements or policies
- Acts of God, natural disasters, or force majeure events
Our total liability for any claim shall not exceed the fees paid for the specific service in question.
9. Indemnification
You agree to indemnify and hold harmless Physicians Credentialing from any claims, damages, or expenses arising from your use of our services, violation of these Terms, or any inaccurate information you provide.
10. Termination
Either party may terminate services under the following conditions:
- Completion of agreed-upon services
- Material breach of these Terms (with notice and opportunity to cure)
- Non-payment of fees after written notice
- Mutual agreement between parties
Upon termination, you remain responsible for all accrued fees and obligations.
11. Dispute Resolution
Disputes shall be resolved through the following process:
- Direct negotiation between parties
- Mediation by a mutually agreed mediator
- Binding arbitration if mediation fails
- Arbitration shall be conducted under American Arbitration Association rules
12. Governing Law
These Terms are governed by the laws of the state where Physicians Credentialing is incorporated, without regard to conflict of law principles. Any legal proceedings shall be conducted in the appropriate courts of that jurisdiction.
13. Compliance and Regulatory
We maintain compliance with applicable healthcare regulations, including:
- Joint Commission standards
- NCQA credentialing standards
- CMS requirements
- State medical board regulations
- HIPAA and healthcare privacy laws
14. Modifications
We reserve the right to modify these Terms at any time. Changes will be posted on our website with an updated effective date. Continued use of our services after changes constitutes acceptance of the modified Terms. Material changes affecting existing service agreements will be communicated directly to affected clients.
15. Severability
If any provision of these Terms is found to be unenforceable, the remaining provisions shall continue in full force and effect. The unenforceable provision shall be modified to the minimum extent necessary to make it enforceable.
